Access to and use of this service is provided by Incisive Media and Toluna subject to the following terms and conditions

 

1. General

 

1.1 Use of this service constitutes your acceptance of these terms and conditions which take effect at the time you complete this registration questionnaire.

1.2 If you do not accept these terms and conditions you must not register to this service.

1.3 Incisive Media and Toluna reserve the right to change these terms and conditions at any time by posting changes online.

1.4 Continued use of this service after such changes to the terms and conditions constitutes acceptance of those posted changes.

1.5 Incisive Media and Toluna reserve the right to make this service unavailable at any time without notice.

 

2. Intellectual property

 

2.1 You acknowledge that all intellectual property rights, including any trade marks or copyright in the content of this service, are owned by Incisive Media and Toluna or their third party suppliers. Nothing contained herein shall be construed as granting any licence or right to use any of the intellectual property of Incisive Media and Toluna  except as otherwise provided on this site.

2.2 Material may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way except for your own personal non-commercial use, or in accordance with Incisive Media and Toluna  terms and conditions.
 

3. Subject Information Statement

 

Incisive Media and Toluna process your personal data (as defined by the Data Protection Act 1998 ("the 1998 Act")) for the following purposes:

 

  • to keep you informed and obtain your views of Incisive Media and Toluna's products, services and activities;
  • the creation of a database of individuals willing to take part in research and surveys;
  • evaluating which individuals registered with Incisive Media and Toluna should be approached in respect of surveys being conducted;
  • to provide you with information about benefits given to you by Incisive Media and Toluna as a result of your responding to survey requests;
  • processing the answers to surveys and summarising the results;
  • undertaking research surveys on behalf of third parties;
  • transferring to service suppliers who undertake processing on our behalf and at our direction;
  • permitting third party research organisations to question individuals registered with Incisive Media and Toluna in respect of surveys;
  • to provide you with information relating to any benefits provided to you by any third parties, including but not limited to a benefit provided to you by our client in response to your answer to a survey request;
  • transferring any personal data to any subsidiary or group company;
  • the administration of your membership of the Incisive Media and Toluna  Panel;
  • statutory and regulatory compliance;
  • to transfer to third parties who provide services to Incisive Media and Toluna  for providing benefits to participants in surveys;
  • contacting you by email to invite you to take part in surveys and when permitted by you, to send you electronic marketing communications keeping you informed about the activities of Incisive Media and Toluna.

 

4. Anonymity

 

Incisive Media and Toluna provide clients with data containing anonymous answers to survey questions or a report setting out and interpreting those answers. No personal data in respect of those individuals responding to a survey will be given to clients.

 

5. Obligations to the Panelist

 

Incisive Media and Toluna will track your survey complete status. At the time you complete 5 Toluna executed surveys the £50 will be sent to you via a check, to the address you provide us.

 

5.1 Incisive Media and Toluna reserve the right to:

 

a) Limit cash payment until you have successfully completed five (5) surveys executed by Toluna, the research panel host 

b) change the value of the Nominated Amount in respect of answering survey and research questions.

 

c) No cash alternative is available in respect of the payment of the reward.

 

6. Obligations of the panelist


6.1 The Panelist warrants that they are 16 years old or over;

6.2 The Panelist warrants that they shall not register with Incisive Media and Toluna for research purposes more than once.

 

6.3  Incisive Media and Toluna has no obligation in respect of any tax due on the Reward given to a member and the member shall be responsible for declaring any income received from Incisive Media and Toluna under this Agreement.


7. Termination


7.1 You can terminate this Agreement at any time by unsubscribing from the Incisive Media and Toluna Panel, this can be done by email or in writing. The termination will take effect up to 10 business days after the receipt of your notice.  Emails should be sent to incisivepanel@toluna.com and letters may be sent to:

7.2 Incisive Media and Toluna  reserve the right to suspend or terminate your access to this site and/or Log-in details at its sole discretion and without notice.


8. Liability

 

Incisive Media and Toluna  will not be liable for any claims, losses, including but not limited to direct, indirect, special, economic and consequential loss or damage (including but not limited to loss of profits, loss of revenue or loss of goodwill), whether in contract, negligence or other tortious action arising out of or in connection with the use of this service.

 

9. Jurisdiction

 

These terms and conditions are governed by and will be interpreted in accordance with English law and the parties submit to the exclusive jurisdiction of the English courts.
